NEWS UPDATE

This is a short note to keep you informed to what is happening within and through the JFRA pending the holding of the AGM.

Within the JFRA there have been some changes. Sam (Bond) has stepped down as chair, and Peter Kim has taken on this role pending the AGM.

Sam has stepped down due to his increasing business commitments. We in the committee and the whole community are deeply indebted to Sam for his Trojan and spirited work with others on so many issues at the Jam Factory. Sam has been one of the persons instrumental in setting up the JFRA, keeping it running, working with others on the many issues that affect us as a community, and at the same time helping build a community at the Jam Factory. He is also a good neighbour and dear friend to many of us, and we shall value this and his experience going forward.

Peter Kim has been living at the Jam Factory since 2003 and has been involved with the committee from a very early stage. Peter has committed an enormous amount of his time and energy towards ensuring that services are being properly provided and charged for by Angel.

Other issues

The Leasehold Valuation Tribunal

You will have seen from the website that the hearing at the LVT has been adjourned until the middle of February. This is not ideal. However, the good news is as set out on the web, so we can take heart from that and work to fight for some more.

The Service Charge Escrow Arrangement

More than half of the residents at the Jam Factory have paid. This is a great success. We are arranging to make a payment to Angel before Christmas, and also aiming at setting up this procedure going forward for the first and maybe second quarter of 2006. Again, please keep an eye on website for further developments on this front.

Planning aApplications - Blocks D, E and Alice Street

The latest is that the Government Office for London ("GOL") has ordered Southwark Council to cease dealing with the planning applications until the GOL has had the time to review the files in relation to all matters. Again, there is more information on this point on the website.

AGM

It is proposed that the AGM will be held in February. Before this notices will go out and a new draft constitution will be available for people to review and to allow the AGM to adopt this going forward.

Right to Manage/Freehold

In the new year, we are going to push this forward as best we can having regard to the fact that there are many issues that Angel should address prior to the residents taking over management of the estate.

Holiday Season

From the committee we wish all our neighbours a very happy, enjoyable, fun, safe Christmas and New Year. When partying at the Jam Factory - don't forget your neighbours - at least invite them!

The ESCROW Arrangement

The final date for payments into the service charge Escrow Account has been pushed back to December 15, 2005.

Important information re: the service charge dispute

The JFRA is preparing our case to defend Angel's claim against residents who have not paid their Service Charges Demands prior to June 2005. The hearing will be on 15 and 16 December at the Leasehold Valuation Tribunal (the "LVT"). We can only represent those residents who are members of the JFRA.

In order to be fully prepared we require your help in preparing the case against Angel. This involves collecting as much evidence as possible about work that Angel have not carried out or carried out poorly. We need your assistance in compiling any correspondence or complaints you have had with Angel since the purchase of your flat. This would include;

1. Complaints that you have made to Angel in respect of services not being provided, and not being provided up to a sufficient standard (e.g. post going missing, insurance details not forthcoming, lights not being fixed. etc.)
2. Copies of correspondence that you have had with Angel - your letters or e-mails to them, and their responses,
3. Details of any services which Angel is due to provide and is not providing such as window cleaning, rubbish collection, etc. (you may not have specifically written to Angel about these matters).

The JFRA needs to hear from everybody so that we can show in great detail and with clarity, what Angel have not been doing. The more responses we receive from each resident the less Angel can contradict it. The LVT is unaware of the history of the Service Charge dispute and therefore we need to back our case with written statements from residents.

Urgent Request

Earlier this week we requested your help in forwarding documentation supporting our claim against Angel at the LVT hearing. Unfortunately we have had very little response. It is imperative that we collect written evidence expressing your complaints over issues with the Service Charge. Unfortunately it will not help if we produce a standard letter that you can use as a template. This kind of letter will not hold up well as evidence in court. We really do need to hear from as many residents as possible. Your letter can be quite simple, you may just wish to comment on issues such as poor service, services not provided or the inflated charge over the original estimates when we purchased.

Please can you each make an effort to put something in writing as soon as possible. Please don't think that other residents are doing this job for you, we need as many responses to this request as possible. There is a danger that should we have no written support for our case, Angel may assert they have never received any complaints and that the lack of evidence from residents implies we are all quite content with the services provided and the cost. This clearly isn't the case, please get writing this weekend.
